قانون توہین رسالت کی کہانی – پہلا باب
9جولائی 1986 کو پاکستان کی قانون ساز اسمبلی نے ضابطہ تعزیرات پاکستان میں ایک ترمیم کی جسے فوجداری قانون ترمیمی ایکٹ نمبر 3 سال 1986 کے نام سے یاد کیا جاتا ہے ۔ اس ایکٹ کا ایک حصہ میں ضابطہ تعزیرات پاکستان کے پچیسویں باب \”جرائم متعلقہ بمذہب\” میں بھی ترمیم کی گئی اور 295 سی کا اضافہ کیا گیا جو حضرت محمدﷺ کی توہین کے بارے میں تھا۔
یہ مختصر سی ویڈیو 9 جولائی 1986 کی قومی اسمبلی کی اس کارروائی کی عکاس ہے جس میں 295 سی منظور کیا گیا تھا اور سزائے موت کو قانون توہین رسالت کا حصہ بنا دیا تھا۔ ممبران کے مطابق یہ چونکہ اجماعی مسئلہ ہے اور پوری امت کے علماء کااس پر اجماع ہے اس لئے سزائے موت کا اضافہ ہی واحد حل ہے ۔ حالآنکہ حقیقت میں یہ سب فریب اور غلط بیانی پر مشتمل تھا ۔ اس ویڈیو کا بنیادی مقصد لوگوں کو آگاہی دینا ہے تاکہ علماء کی صحیح آراء سے وہ واقف ہو سکیں۔

In July 1986, the National Assembly of Pakistan passed Criminal Law (Amendment) Act, III of 1986, S. 2. The passage of this Act amended Chapter XV of the Pakistan Penal Code, entitled “Offences Relating to Religion”, via the creation of Article 295-C, itself titled “Use of Derogatory Remarks, etc., in respect of the Holy Prophet (PBUH)”.
This short video tells the story of the National Assembly session on 9 July 1986 leading up to the passage of the 295-C. It was during this session that 295-C took on its final form and punishment by death was introduced into the legislation. As the video shows, Members of the National Assembly who supported the introduction of the death penalty claimed that their position was in accordance with the universal consensus of Islamic legal scholars throughout history. In fact, however, the position of those who supported the death penalty was based on misunderstandings and misrepresentations of the very scholars they claimed to be following. As such, this video seeks to educate the public about the real positions of these scholars.
